PI.EXCHANGE PTY LTD (ACN 613 811 671) trading as Mentana and its related entities (“MENTANA”, “MENTANA.AI”, “PI.EXCHANGE”, “we”, “us”, “our”, “the Company”) collect your personal information for the purposes of communicating with you and providing and improving our products and services. By providing your personal information you agree to us collecting, using, and disclosing your personal information for those purposes and otherwise in accordance with our Privacy Policy below, which contains information about how we use your personal information, and how you can access, correct, or make a complaint in relation to your personal information.
NSW Consumer Disclosure Statement (NSW Residents Only)
If you are purchasing a licence and you are located in New South Wales, AUSTRALIA (“NSW”), then you should be aware that End User Licence Agreement (EULA) for Mentana' Software as a Service (SaaS) products known as "Demand Forecasting Studio", "Customer Insights Studio", "FlexiBuild Studio" and/or "AI & Analytics Engine" (individually and/or collectively known as "Software") of Mentana may contain terms which may be prejudicial to you, and which under NSW law we are required to disclose to you. These include:
- If, by using our Software or by breaching any of the terms of the EULA, you or any person you authorise to use the Software (Authorised Users) causes Mentana to suffer loss or damage, you may be required to compensate us for the full extent of the loss or damage;
- If Mentana has breached any of its obligations to you, and you suffer loss or damage, Mentana has limited its liability for direct and indirect losses you may incur. This means Mentana will not be liable for loss such as economic loss, loss of profits, contracts, revenue or data.; and
- Mentana requires certain indemnities from you. These include an indemnity for your breach of the EULA or by a breach of the EULA caused by your Authorised Users, as well as an indemnity for third party claims made against Mentana due to your acts or omissions.
